Family Unity Law and the New Immigration Rule:

Keeping Families Together

The United States' immigration policies are beginning to acknowledge the importance of family unity. Previously, family members who entered the United States illegally, that is, without proper inspection, were forced to apply for an unlawful presence waiver if they wished to apply for a green card or visa. This means, they had to first depart the country and were forced to apply in their home countries. This triggered the 3/10 year bar during which time he/she may not return to the United States. This caused extreme hardship on families due to separation.

Recently, however, the New Immigration Rule and Family Unity Law are striving to keep families together during the process. The Family Unity Law hopes to:

"...maintain[ing] the family group without deviation or change. The family group shall include the spouse, unmarried minor children who are not members of some other household, and parents who reside regularly in the household of the family group."

Those that qualify may then stay with their families while they begin the process of becoming a legal permanent resident of the United States. In the same way, the New Immigration Rule aims at reducing the length of time families are forced apart. Those who apply for these new regulations are family members of United States' citizens, not legal permanent residents.
