New Family Unity Program and New Immigration Law:

How it could affect you and your family

The New Family Unity Program is part of a series of new immigration laws that are overhauling our current immigration system. The New Family Unity Program consists of rules and provisional waivers that aim to help applicants and their families avoid unnecessary and lengthy separation. Some of these include the "Obama waiver", I-601a form, and the new family unity waiver. These all apply to family members of a US citizen or legal permanent resident who entered the United States without proper inspection but now wish to pursue their green card, visa, or citizenship.

Previously, these people would have to apply for an unlawful presence waiver, acknowledging that they had entered this country illegally, and then report back to their home countries to apply for a green card or visa. Unfortunately, this triggered the 3/10 year bar, during which time they were prohibited from returning to the United States. With new immigration laws and the New Family Unity Program, however, this step can be bypassed. Families whose situations apply to one of these provisional waivers or rules under the New Family Unity Program may begin this application while they are still together in the United States. That way, they are not forced to enact the 3/10 year bar.

The United States is reforming its current immigration system to take into account family unity and the extreme hardships that come with lengthy separations.
