New Family Unity Waiver, Family Unity Act

The new family unity waiver, or "New Law," was added in the Federal Register earlier this year. Although this is actually not yet a law, as it has not been passed by Congress, this new family unity waiver is a step forward in the fight for immigration reform. The Family Unity Act, if approved by Congress, would make the new family unity waiver a law and will help keep families together.

This new law will affect those who are separated from their family members in the United States because of the 3 or 10 year bar provision of the 1996 Illegal Immigration Reform and Immigrant Responsibility Act. Under this provision, families of those in the United States with a green card or citizenship may not return to the United States for a period of 3 to 10 years after their legal stay is completed (usually a period of 180 days). If they do wish to return, they must apply for a 3/10 year bar waiver at the U.S. embassy in their home country.

If the Family Unity Act is passed and the new family unity waiver is enacted, families may legally apply for permanent residency before leaving the country. This way, they can avoid the 3/10 year bar provision and will not be separated from their families.
